The Botulinum Toxin and Cosmetic Fillers (Children) Act grant determination 2021 to 2022

Background

In October 2021, the Botulinum Toxin and Cosmetic Fillers (Children) Act came into force.

The main purpose of the Act is to prohibit the administering of botulinum toxin, or a filler by way of injection for a cosmetic purpose, to a person under 18 in England. It will also be an offence to make arrangements to undertake, or arrange for another person to undertake, these procedures on a person under 18 in England.

The act creates a new burden for local authorities. Guidance has been published to support local authorities and the police in successfully implementing the legislation.

The Department of Health and Social Care (DHSC) will cover the cost of the new burden through a non-ringfenced revenue grant under section 31 of the Local Government Finance Act 2003. The grant will support local authorities in England with expenditure lawfully incurred or to be incurred because of the Botulinum Toxin and Cosmetic Fillers (Children) Act 2021.

The grant

In 2021 to 2022 the total Botulinum Toxin and Cosmetic Fillers (Children) Act grant to local authorities will be £758,671.

The Secretary of State has determined, pursuant to section 31 of the Local Government Act 2003, to pay grants to relevant authorities in the amounts indicated for the financial year 2021 to 2022 (1 October 2021 to 31 March 2022).

The grant allocations have been determined via the public health grant funding methodology. Through the public health grant model, DHSC pays 152 upper-tier local authorities each year via section 31 of the Local Government Act 2003.

The grant for 2021 to 2022 includes an adjustment to cover familiarisation and training costs.
